Rental Agreement

📝 Happy Hearts Party Rentals: Equipment Rental Agreement

This Rental Agreement ("Agreement") is made between Happy Hearts Party Co ("Owner") and the undersigned Renter ("Renter"). By signing this agreement, the Renter agrees to the following terms:

1. Rental Period & Timing

• Pickup/Delivery: Items will be available for pickup or delivered on Friday between 4:00 PM and 7:00 PM (Monday for weekday rental).

• Return: All items must be returned to Happy Hearts or ready for collection Monday before noon (Thursday for weeday rental)

• Late Returns: Late returns may be subject to a daily late fee of the full rental price unless prior arrangements have been made.

2. Damage, Loss, and Replacement

• Inspection: The Renter acknowledges they will inspect the items at the time of set up and will notify any damages by Sat at 10 am via pictures or they may be held responsible for those damages.

• Responsibility: The Renter assumes all responsibility for the equipment while in their possession including theft.

• Damage Policy: In the event that equipment is returned broken, damaged (beyond normal wear and tear), or missing parts, the Renter agrees to pay the full cost of repair or the current retail replacement value of the item.

• Cleaning: Items should be returned in a reasonably clean state. Excessive cleaning requirements (e.g., mud, stains, or sticky residue on electronics/games) may incur a cleaning fee of $50.

• By signing this you agree you either purchased the damage waiver for 15% or waived it. You agree this damage waiver is non refundable and covers minor damage to items like scratches and dings, but does not cover you for replacement cost if the item is no longer in useable condition.

3. Liability & Safety

• Assumption of Risk: The Renter understands that using party equipment (including but not limited to nerf guns, water guns, ball pits, inflatable bouncers, karaoke machines, bubble machines, and yard games) carries inherent risks.

• Release of Liability: Happy Hearts Party Co and its parent company Captain Overkeel LLC are not responsible for any injuries, accidents, or property damage that may occur during the rental period. The Renter agrees to supervise all children and guests during the use of the equipment.

4. Payment & Cancellation

• Full payment is required to secure your rental date via the website.

• Cancellations made within 30 days of the event will be subject to a cancellation fee of 50%, No refunds for cancellations within 14 days.
